Rentals

These terms supplement Common Terms (00) and the conditions accepted before payment.

All policies · General terms · Privacy Policy

1. Vehicle use

The vehicle is for personal use within approved areas. Subleasing or re-renting to anyone is strictly prohibited, without exception. Every rental is contracted directly with Omega; other commercial use needs prior written approval but never permits subleasing. The agreement identifies the unit, authorized use, dates, pickup and return place/time, equipment, mileage, price and conditions. Road vehicles, off-road vehicles and bicycles have different permitted areas; delivery does not expand them.

2. Pets

Pets are accepted in car rentals without an upfront pet fee or advance notice. For other units, suitability and any safety restrictions must be confirmed. You remain responsible for attributable pet damage and extraordinary cleaning, not a fee simply because a pet was present. Applicable assistance-animal access rights are respected. Cleaning must be supported by the unit’s condition and the disclosed cleaning rule.

3. Authorized driver

Only drivers listed in the agreement may drive; each additional driver requires Omega’s prior approval. Meet the unit’s age, license, ID and experience requirements. The customer cannot authorize an unlisted driver. Do not abandon the unit or leave it outside the agreed location without authorization. Reasonable, documented recovery costs may be charged when the unauthorized return or abandonment is attributable to you.

4. Fuel

Car rentals are full-to-full and require premium gasoline. If the documented delivery level is lower, return the actual recorded level. Other fuel-powered units must be returned at their recorded level using the specified fuel. A shortage is charged as the missing fuel plus a USD 20 refueling service fee, with the calculation and payable currency disclosed. This is not a full-tank charge unless a full tank is missing. The rule does not apply to bicycles or to fuel expressly included in a different booked service.

5. Vehicle condition

Return the unit in its delivery condition, allowing normal use and wear. No smoking inside. Extraordinary cleaning for excessive sand, mud, salt, stains, waste or odors costs USD 20–100 according to the work required. Ordinary dust from authorized off-road use is not, by itself, extraordinary cleaning. Omega records delivery and return condition in photos/video and documents any proposed charge. Keep your own record and report pre-existing discrepancies before departure.

6. Damage and responsibility

Report damage, impact, scratches, loss or equipment failure immediately when safe. You are responsible for legally attributable damage not covered by the applicable contracted insurance. Pre-existing damage, ordinary wear and mechanical faults not attributable to you are excluded. An estimate or charge must identify the damage, evidence, causal basis and calculation, taking coverage and any deductible into account. There is no duplicate recovery for an item already paid by insurance or another party. A security deposit does not automatically limit proven liability, but these terms do not authorize unlimited subsequent charges.

7. Insurance

Car rentals include insurance with a published customer deductible of 15% of the total cost of damages for an accident or damage claim, under the applicable rental agreement and policy. Insurance included does not mean zero financial responsibility. Coverage, limits, exclusions and any different type of claim, including theft, must be explained using the actual policy before payment; this paragraph does not create an unlisted benefit or a universal theft deductible.

Ordinary off-road, dirt-bike, motorcycle and scooter rentals do not include guest insurance, a damage waiver or third-party coverage unless the exact product expressly states otherwise in writing. A car’s insurance does not cover another rental category. Any legal insurance obligation of the provider remains unaffected. Negligence, prohibited use, unauthorized drivers and driving outside permitted areas are assessed under the actual contract and policy, not a promise that every loss is covered. A deposit is not insurance. Report incidents promptly and follow the disclosed claims procedure.

8. Fines and violations

You are responsible for traffic fines or violations generated during the rental period when attributable to your use or an authorized person’s conduct. Any claim must identify the official notice, date, unit and connection to the rental. This does not transfer the provider’s own regulatory violations to you or permit duplicate charges. A later notice is handled through the documented claim and authorized payment process, not indefinite retention of the entire deposit.

9. Prohibited use

Do not operate under the influence of alcohol or drugs, drive off approved roads without authorization, transport illegal substances or tow another vehicle. Do not race, perform stunts, overload the unit or allow an unauthorized driver. Follow the route restrictions for the actual unit; permission for an off-road rental is not permission to enter restricted beaches, protected areas or prohibited roads. A justified safety stop is handled under the common terms, not an automatic forfeiture of every payment.

10. Late returns

Cars must be returned by the agreed time and never later than 7:00 p.m., when the office closes. The 15-minute grace period ends at the earlier of 15 minutes after the agreed return time or 7:00 p.m. There is no grace after 7:00 p.m. For example, a 6:50 p.m. return is allowed only until 7:00 p.m., not 7:05 p.m.

After the grace period and before closing, a proportional hourly late charge applies at the rate disclosed in the agreement. A customer-caused car return after 7:00 p.m. incurs the corresponding additional 24-hour rental charge. That charge replaces, rather than duplicates, hourly charges for the same delay. The hourly and 24-hour rates must be disclosed before contracting. Paying a late charge does not authorize an extension or an unattended after-hours drop-off; contact Omega for safe return instructions. No late charge applies merely because Omega starts inspection or an agreed pickup late when the customer and unit were ready at the agreed place on time. Other units follow their expressly confirmed return schedules; the car closing rule does not limit nighttime transportation services.

11. Security deposit

Security deposits per unit:

Unit / rental periodDeposit (USD)
Car700
ATV700
UTV1,500
Dirt bike700
Scooter400
Navi Honda400
Honda XR150L500
Mountain bike — hourly rental300
Mountain bike — daily rental500

Other durations and products require their own disclosed amount. These are deposits, not rental prices or deductible amounts.

The booking identifies whether the guarantee is a payment or card hold and explains inspection and release. Omega inspects the returned unit and itemizes justified damage, missing items, extraordinary cleaning, outstanding charges and known attributable fines. Only supported amounts may be retained; the unaffected amount is released once that inspection and verification are complete. Bank processing may take additional time. Unknown future fines do not justify indefinite retention. Original IDs are not retained as the security deposit, and the deposit is not an automatic limit on proven liability.

12. Assistance, delivery and contact

Delivery and pickup are separate services. Each delivery or pickup costs USD 25 per vehicle in El Pescadero, Cerritos, Villa Santa Cruz, Hotel Paradero and Hotel San Cristóbal, or USD 15 per vehicle around central Todos Santos. Each operation is charged separately. Other locations require a quote. Confirm the exact address, availability, time and each charge before booking. Ordinary off-road rental delivery to Los Cabos or an airport is not included or automatically available. These fees do not apply to passengers booking transportation.

For assistance attributable to misuse or negligence, the base service fee is USD 20, with a distance adjustment explained and agreed where feasible before dispatch. This fee does not apply to a mechanical problem. Incident recovery, delivery and pickup are different services; charges need a justified, disclosed basis and cannot duplicate the same work. Mandatory assistance duties remain. Contact: +52 612 136 2372 or info@omegatours.mx.

13. Booking, cancellation and supporting documents

Document 00’s cancellation policy applies unless a different lawful rental policy was disclosed before payment and incorporated into the contract. A specific rental contract and any mandatory registration remain necessary. Ordinary rentals exclude a guide, GPS route and continuous tracking unless expressly booked. Motorcycles and scooters require experience; orientation is not a full course. Extras require acceptance. Consumer rights and Omega’s own responsibilities remain protected. Confirmed rentals keep their accepted conditions; later updates are not retroactive.
