Omega Tours is the commercial name used for the provider identified in your quotation and contractual documents. Your agreement comprises these common terms, the applicable category terms, the service description or quote, the booking confirmation and any required specific contract. Only lawful conditions disclosed before payment may add obligations; essential charges and exclusions cannot first appear at check-in. A specific condition controls the issue it addresses, not unrelated services. A summary does not replace the full terms. Binding advertised promises and statutory rights remain protected.
Before payment, Omega identifies the service, operator, date, local time, duration, meeting place, participants or vehicles, essential inclusions and exclusions, total price, payment schedule, requirements and cancellation policy. Any security deposit and coverage are disclosed separately. A quote is not a confirmed reservation. Confirmation requires acceptance of the requested payment and written confirmation from Omega. If Omega cannot confirm the service, the amount received is returned unless you expressly accept an alternative. Check your confirmation and report errors promptly; this does not transfer responsibility for Omega’s errors to you.
The total payable price is disclosed in Mexican pesos, including taxes and mandatory charges. A USD reference may also be shown; the charge currency and applicable conversion are disclosed before payment. Any legally applicable right to pay in Mexican currency is respected. An advance payment counts toward the service price; a security deposit secures justified incident-related charges and is not insurance. There is no universal advance-payment percentage or security-deposit amount. Customer-requested changes and extras require a stated price and acceptance. Tips are voluntary. Receipts and applicable tax invoices are provided. A later price change does not alter a confirmed booking.
Unless a different lawful service-specific policy was clearly disclosed before payment, the following applies: more than 48 hours before the scheduled start, a full refund; from 24 to 48 hours, including both limits, a 50% refund; less than 24 hours or a customer-caused no-show, no refund. Refund percentages apply to the amount actually paid for the canceled service or component, including applicable taxes, and exclude the security deposit. This rule does not authorize automatic collection of an unpaid balance. A special rental, event or supplier policy applies only to the services it identifies and only if disclosed before payment. Hours are consecutive and measured against the service’s local start time. Send an identifiable request by email, WhatsApp or an enabled booking channel; receipt, not when staff reads it, determines the time, unless the law provides a more favorable rule. Applicable statutory withdrawal and refund rights remain available, including LFPC Article 56 where applicable and subject to its exception for services scheduled ten business days or less after the purchase order.
Date, participant and service changes require availability and written confirmation. Omega discloses price differences before acceptance. Reductions may be partial cancellations; the same item is not penalized twice. Arrive at the specified location and time. Any arrival recommendation is different from a waiting allowance. Customer-caused delays may shorten or prevent service under the disclosed terms. A no-show requires that Omega was able to provide the service and the applicable waiting limit was exceeded. Voluntary early departure from a properly delivered service does not itself create a proportional refund; service defects and Omega-caused failures are not voluntary departure.
Omega may adjust or suspend a service for an objective safety risk, weather, official closure or access restriction. The reason and available options will be explained. Staff shortages, overbooking or poor maintenance are not automatically force majeure. If Omega cancels before the start, you may choose available rescheduling without penalty or a refund for the canceled service. For partial performance, the amount paid for the portion not provided is refunded using a reasonable breakdown. A material change cannot simply remove an essential inclusion without a remedy. Alternative services or credits require acceptance. Remedies and legally applicable compensation for an attributable failure remain available; natural events do not automatically trigger every statutory compensation.
Omega processes qualifying refunds promptly, explains the calculation and provides confirmation of the refund instruction. Refunds use the original payment method and currency where technically possible; a safe alternative requires agreement. Bank posting time is separate. A disputed item does not justify withholding an undisputed refund, and recovery from a supplier is not an indefinite condition for refunding the customer. Mandatory legal deadlines remain applicable. Report a concern with your booking reference and the relevant facts; Omega reviews it and communicates the outcome or an update. Each participant must meet the service-specific requirements and follow safety instructions. Intoxication, threatening behavior or demonstrated inability may justify refusal or suspension, without discrimination. Financial consequences depend on the reason, disclosed terms and law; payment is not automatically forfeited. Organizers must share the conditions but cannot sign every adult’s individual consent. Minors require the appropriate legal authorization and supervision. Outdoor and vehicle activities may involve serious injury or death. Risk acknowledgment does not release Omega from its own negligence, unsafe equipment, inadequate maintenance or breach. Damage charges require attribution and evidence; a deposit is neither automatically forfeited nor an automatic cap on proven liability. Belongings entrusted to Omega and losses attributable to Omega are not excluded from responsibility.
Omega discloses whether it operates a service or arranges it with an identified supplier, and shares the applicable conditions before payment. Outsourcing does not erase Omega’s own booking, collection, information or coordination obligations. Personal data is processed under the separate Privacy Notice; sensitive information requires the applicable consent and safeguards. Promotional image use and marketing permissions are separate from service acceptance. A signature, an acceptance box that starts unchecked and is selected by the customer, or an express message must identify the accepted documents and edition. Browsing or asking a question does not create a payment obligation. You receive an accessible copy.
Mexican law and applicable Baja California Sur provisions govern, preserving access to PROFECO and competent authorities or courts. Required registered contracts are used where applicable; these website terms do not replace them. English is the primary customer-facing presentation, with an equivalent Spanish text; this does not give English legal precedence. No translation reduces rights or promised obligations. The accepted edition applies to the booking; later updates do not unilaterally change it. An invalid provision is governed by applicable law without automatically invalidating the rest.
