Off-Road Activities

These terms supplement Common Terms (00) and the conditions accepted before payment.

1. Choose the correct experience

The confirmation identifies a guided tour, a self-guided experience or a riding class; these are different services. It states the vehicle type, authorized drivers and passengers, duration, route or approved area, included equipment and any pickup. A rental does not become a guided or GPS-supported experience merely because an off-road vehicle is used. Fuel, photographs, park fees and transfers are included only as stated before purchase.

2. Age, license and experience

Drivers on Omega-operated ATV experiences must be at least 18; drivers on Omega-operated UTV experiences must be at least 21. Other operators, riding classes, dirt-bike models and passenger seats have their own age, license, size and experience requirements, disclosed for the exact product before payment. Do not apply one vehicle’s age to every participant. Full dirt-bike routes require prior riding experience. Mountain-bike and e-bike participants must be able to control the bicycle safely. A briefing is not a substitute for the required experience.

3. Check-in and safety assessment

Arrive at the specified time, present the required documents and complete the safety orientation and applicable individual forms before departure. Tell Omega confidentially about relevant restrictions that may affect safe participation. Staff may assess control of the vehicle and decline unsafe participation for a stated reason. A paid class, different vehicle or alternative service requires a separate price and your agreement; it cannot be imposed as an undisclosed purchase. A class does not guarantee approval for a later tour or rental.

4. Equipment and riding conduct

Use the required helmet and protective equipment; wear seat belts where fitted. Only authorized riders may operate the unit, and only approved seats may carry passengers. Follow the guide, spacing and route instructions. Racing, stunts, jumping, overloading, intoxicated operation and unsafe phone use while driving are prohibited. Stop safely before adjusting equipment or using a phone. Do not change drivers without approval.

5. Routes, beaches and private land

Stay within the approved route and permitted operating area. A vehicle’s off-road capability does not authorize access to a beach, dune, protected area, private property or highway. Follow vehicle-specific legal and operational restrictions. Do not enter water, closed areas or an unapproved route. Avoid wildlife and do not damage vegetation. No rule in this section is a blanket highway ban for road-legal rental cars or passenger transportation.

6. Self-guided navigation

A self-guided booking must expressly include the route, device or access method, return deadline and assistance procedure. Follow the assigned route; a map or GPS is not permission to explore elsewhere. If the route or device becomes unusable, stop in a safe location and contact Omega rather than improvise a route. Follow the pre-departure instructions for loss of signal. Navigation does not promise continuous tracking, cellular coverage or immediate rescue. Equipment supplied by Omega must be returned in its documented condition, allowing normal wear.

7. Vehicle condition, deposits and coverage

Omega-operated ATV and UTV experiences do not include guest vehicle-damage insurance, a damage waiver or medical-expense coverage unless the exact booked product expressly includes them. A security deposit may be required: USD 700 for an ATV or USD 1,500 for a UTV, when stated for the booking. A deposit is not insurance. In contrast, Tierra Sagrada ATV/UTV and Can-Am X3 packages that expressly list the operator’s mandatory vehicle insurance/damage waiver and medical-expense coverage include those items under that operator’s actual terms, limits, exclusions and deductibles. They are not a promise of zero customer liability. No coverage is transferred automatically to a different vehicle, class or operator. Before paying, receive the applicable coverage details and incident procedure. Document the unit’s condition; charges require attributable damage and evidence, excluding pre-existing damage and normal wear. These commercial inclusions do not remove any legally required coverage or the provider’s own legal duties.

8. Breakdowns, injuries and recovery

Prioritize safety, stop using unsafe equipment and contact Omega. Follow the guide, authorities and applicable insurer’s instructions. Do not conceal an incident or undertake unauthorized repairs, except to avoid greater harm. Recovery or assistance is not automatically charged to you because it occurred during your booking; cause, agreement and evidence matter. Mechanical faults not attributable to you are not treated as misuse.

9. Changes, weather and cancellations

Customer cancellations follow document 00: more than 48 hours, full refund; 24–48 hours, 50%; less than 24 hours or a customer-caused no-show, no refund, unless a lawful product-specific policy was disclosed before payment. The refund basis and statutory protections in document 00 apply. Customer-requested changes require availability and confirmation. Unsafe conditions, route closures and Omega cancellations follow the common rescheduling/refund rules. No wildlife sighting, trail condition or particular photograph is guaranteed unless expressly promised. An included or additionally booked ground transfer also uses document 03.

10. Risk acknowledgment and governing documents

Uneven terrain, loss of control, collisions, falls, heat and remote conditions can cause serious injury or death. Follow the briefing and stay within your ability. This acknowledgment is not a waiver of Omega’s negligence, maintenance obligations or legal duties. Read these full terms with document 00, General Terms and Conditions, and any service-specific safety agreement. Individual consent forms do not replace accurate pre-sale information.
