Welcome to our services. This document establishes the terms and conditions that regulate the use of our services, including Tours, Rentals and Transportation. By reading this document and using our services, you agree to comply with these terms and conditions. Please read each section carefully to understand your rights and responsibilities.
DEFINITIONS
In this document, the following terms will have the meanings indicated below :
- “Company“, “OMEGA” : Refers to Omega Tours, Rentals & Private Transportation, also known as Omega Tours and Omega Transportation.
- “Services” : Refers to all services offered by OMEGA, including tours, rentals and transportation services.
- “User“, “You” : Refers to any person who uses our services.
1. PRIVATE TRANSPORTATION
1.1 Prices per vehicle.
1.2 Private service (group or personal).
1.3 Vehicles and drivers have a federal license.
1.4 OMEGA is not responsible for lost or forgotten items (extra charge for home delivery).
1.5 Information about your airline and flight is required to coordinate transportation.
1.6 There is no charge for pets in a carrier cage (if you do not bring an additional $35 USD).
1.7 The courtesy waiting time is 10 minutes from the scheduled time, if exceeded, a charge of 30 minutes will be made.
1.8 OMEGA is not responsible for accidents or injuries that occur during transportation.
1.9 There are no refunds due to unforeseen external conditions, rescheduling will depend on our availability.
1.10 There are no refunds for cancellations less than 24 hours in advance.
1.11 Cancellations with 24 hours notice will be entitled to 50% of the total cost of the service.
1.12 No charges apply to cancellations more than 48 hours in advance.
1.13 In the event that a passenger vomits in the Van, an additional charge of $100 USD will be imposed.
1.14 It is not allowed to bring drinks.
1.15 In the event of a fight, an additional charge of $100 USD will be imposed in addition to liability for any damage caused to the unit.
3.1 HORSEBACK RIDING TOUR
3.1.1 Includes
- Helmet
- Water and snacks
- Guide
- Transportation to the Ranch from our offices.
- Tour Duration: 2 hours
- Departures based on prepaid reservations
3.1.2 It is necessary to have official identification (INE or passport).
3.1.3 Weight limit per horse 242 lb (110 kg).
3.1.4 Minimum age: 8 years.
3.1.5 Comfortable, closed-toe shoes, long pants, and biodegradable sunscreen are recommended.
3.1.6 For safety reasons, we cannot allow participants with the following conditions: pregnant women, back problems, recent surgery, influence of alcohol or drugs.
3.1.7 Only one person may ride per horse, whether adult or child, for safety.
3.1.8 Show up at our facilities, 15 minutes before the time of your reservation, for the delivery of safety equipment and preparation of documentation.
3.1.9 15 minutes of tolerance will be granted from the reserved time; Failure to comply with this deadline will be considered a no-show cancellation and no refund will be granted.
3.1.10 There are no refunds due to unforeseen external conditions, rescheduling will depend on our availability.
3.1.11 There are no refunds for cancellations less than 24 hours in advance.
3.1.12 Cancellations with 24 hours notice will be entitled to 50% of the total cost of the service.
3.1.13 No charges apply to cancellations more than 48 hours in advance.
3.1.14 Those who do not attend must pay the full fees for the activity.
3.1.15 OMEGA is not responsible for lost or forgotten items.
3.1.16 OMEGA is not responsible for accidents or injuries that occur during the tour.

3.2 WHALE SHARK WATCHING IN LA PAZ
( November – April )
This tour has the option to include Transportation ( Round trip La Paz – Todos Santos ).
3.2.1 Includes
- Access bracelet to protected natural area
- Certified guide
- Snorkel kit
- Safety equipment
- Snacks (water, soft drink, seasonal fruit and cookies).
- Safe to participate in the activity
- Transportation (optional)
3.2.2 It is necessary to have official identification (INE or passport)
3.2.3 Activity time with whale shark: 2 – 3 hours. Activity with full-day logistics.
3.2.4 For safety reasons, we cannot allow participants with the following conditions: Pregnant women, back problems or recent surgery, influence of alcohol or drugs.
3.2.5 Clients must arrive at our facilities 15 minutes before the scheduled departure time to complete the corresponding documentation.
3.2.6 They will have 10 minutes of tolerance from the scheduled departure time; after 10 minutes, it will be considered cancellation for no-show. There will be no refund.
3.2.7 The tour may be modified depending on weather conditions.
3.2.8 There is a possibility of not finding the shark since it is a totally natural excursion. Refund not applicable.
3.2.9 Tours canceled by the company external to Omega Tours due to natural phenomena and/or recommendations from the authority, will be rescheduled or 100% refundable.
3.2.10 Cancellations or modifications for reasons beyond the control of the company, no refund applies.
3.2.11 Those who do not attend must pay the full fees for the activity.
3.2.12 OMEGA is not responsible for lost or forgotten items.
3.2.13 OMEGA is not responsible for accidents or injuries that occur during the tour.

- Biodegradable sunscreen
- Sunglasses
- Swimsuit
- Towel and beach shoes
- Hat or cap
- Dry clothes for the return trip

3.3 WHALE WATCHING IN TODOS SANTOS
( November – March )
This tour has the option to include Transportation ( Round trip La Paz – Todos Santos ).
3.3.1 Includes
-
- Certified local captain
- Water, burritos or tamales
- Safety equipment
- Travel insurance
3.3.2 It is necessary to have official identification (INE or passport).
3.3.3 Maximum 4 people per boat.
3.3.4 Duration : 4 hours.
3.3.5 Departure 7:30 am from the office.
3.3.6 Minimum age 5 years.
3.3.7 For safety reasons, we cannot allow participants with the following conditions: Pregnant women, back problems, recent surgery, influence of alcohol or drugs.
3.3.8 Clients must appear at our facilities at 7:00 am to complete the corresponding documentation.
3.3.9 A tolerance margin of 15 minutes will be granted from the reserved time. If this limit is exceeded, it will be considered a no-show cancellation and no refund will be made.
3.3.10 There are no refunds due to unforeseen external conditions, rescheduling will depend on our availability.
3.3.11 There is the possibility of not finding whales of any kind since it is a totally natural excursion. Refund not applicable.
3.3.12 Tours canceled by the company external to Omega Tours due to natural phenomena, recommendations from the authority or causes attributable to the company, will be rescheduled or 100% refundable.
3.3.13 Cancellations or modifications for reasons beyond the control of the company, no refund applies.
3.3.14 Those who do not attend must pay the full fees for the activity.
3.3.15 OMEGA is not responsible for lost or forgotten items.
3.3.16 OMEGA is not responsible for accidents or injuries that occur during the tour.

3.4 SWIMMING WITH SEA LIONS – ESPIRITU SANTO ISLAND
( September – May )
Swimming near the sea lions is prohibited from June 1 to August 31.
During these dates, tours are conducted solely for observing the sea lions from a distance aboard the boat.
3.4.1 Includes

- Bracelet payment and access rights to the protected natural space
- Certified guide
- Snorkel kit
- Safety equipment
- Water and snacks
- Safe to participate in the activity
- Light Picnic Lunch on the Island
- Ceviche and sandwiches
- Round trip La Paz – Todos Santos ( optional )
3.4.2 It is necessary to have official identification (INE or passport).
3.4.3 This activity is seasonal, based on the sea lion mating season, which is from June 1 to June 31. of August.
3.4.4 Excursion to the sea lions: 2 – 3 hours. It takes a full day.
3.4.5 For safety reasons, we cannot allow participants with the following conditions: Pregnant women, back problems or recent surgery, influence of alcohol or drugs.
3.4.6 Clients must arrive at our facilities 15 minutes before the scheduled departure time to complete the corresponding documentation.
3.4.7 They will have 10 minutes of tolerance from the scheduled departure time; after 10 minutes, it will be considered cancellation for no-show. There will be no refund.
3.4.8 The tour may be modified depending on weather conditions. Refund not applicable.
3.4.9 There is the possibility of not seeing and/or finding sea lions, since it is a totally natural excursion. Refund not applicable.
3.4.10 Tours canceled by the company external to Omega Tours due to natural phenomena and/or recommendations from the authority, will be rescheduled or 100% refundable.
3.4.11 Cancellations or modifications for reasons beyond the control of the company, no refund applies.
3.4.12 Those who do not attend must pay the full fees for the activity.
3.4.13 OMEGA is not responsible for lost or forgotten items.
3.4.14 OMEGA is not responsible for accidents or injuries that occur during the tour.

3.5 SPORT FISHING IN TODOS SANTOS
3.5.1 Includes

- Certified local captain
- Water, burritos or tamales
- Fishing team
- Bait
- Safety equipment
- Travel insurance
- Fishing license
- The fish can be fileted and bagged upon returning to the beach
3.5.2 It is necessary to have official identification (INE or passport).
3.5.3 This activity is seasonal, based on the sea lion mating season, which is from June 1 to June 31. of August.
3.5.4 Excursion to the sea lions: 2 – 3 hours. It takes a full day.
3.5.5 For safety reasons, we cannot allow participants with the following conditions: Pregnant women, back problems or recent surgery, influence of alcohol or drugs.
3.5.6 Maximum 4 per boat.
3.5.7 Activity in Todos Santos with local fishermen.
3.5.8 Duration 4 hours.
3.5.9 Departure at 7:30 am.
3.5.10 Minimum age: 5 years.
3.5.11 We strongly recommend the use of biodegradable sunscreen, cap or hat, long-sleeved shirt, and sunglasses.
3.5.12 Clients must appear at our facilities at 7:00 am to complete the corresponding documentation.
3.5.13 A tolerance margin of 15 minutes will be granted from the reserved time. If this limit is exceeded, it will be considered a no-show cancellation and no refund will be made.
3.5.14 There are no refunds due to unforeseen external conditions, rescheduling will depend on our availability.
3.5.15 Those who do not attend must pay the entire activity fees.
3.5.16 There is the possibility of not fishing at all since it is a totally natural excursion. Refund not applicable.
3.5.17 Trips canceled by the company external to OMEGA due to natural phenomena and/or recommendations from the authority, will be rescheduled or 100% refundable.
3.5.18 Cancellations or modifications for reasons beyond the control of the company, no refund applies.
3.5.19 OMEGA is not responsible for lost or forgotten items.
3.5.20 OMEGA is not responsible for accidents or injuries that occur during the tour.

3.6 ATVs – GUIDED TOUR
3.6.1 Includes

- Bilingual guide: English and Spanish
- Safety equipment: helmet, goggles and scarf
- Assistance for any incident during the tour
- Gasoline
- Waters and snacks
- Choice of route according to your preference
3.6.2 Minimum age to drive ATV: 18 years / Minimum passenger age on ATV: 10 years.
3.6.3 Deposit of $700 USD per ATV on credit card.
3.6.4 It is necessary to have official identification (INE or passport).
3.6.5 For your safety we do not allow: Pregnant women, back problems or recent surgery, anyone under the influence of alcohol or drugs.
3.6.6 Damage to the ATVs, to your person or to third parties, is your responsibility.
3.6.7 Driving on beaches and federal highways is prohibited.
3.6.8 Single ATV maximum weight: 330 lbs. (150kg) / ATV Premium Double: 550 lbs. (250kg).
3.6.9 There are no refunds due to unforeseen external conditions, rescheduling will depend on our availability.
3.6.10 Those who do not attend must pay the full fees for the activity.
3.6.11 Late arrival policy: A tolerance period of 15 minutes is established after the scheduled time. In case of delay, the tour will be rescheduled according to our availability or the duration of the activity will be shortened.
3.6.12 There are no refunds for cancellations less than 24 hours in advance.
3.6.13 Cancellations with 24 hours notice will be entitled to 50% of the total cost of the service.
3.6.14 No charges apply to cancellations more than 48 hours in advance.
3.6.15 OMEGA assumes no responsibility for accidents or injuries that may occur during the tour.
3.6.16 You can adjust your itinerary at least 24 hours in advance before its start. These changes are free and do not carry penalties, as long as there is availability for the required modification.
3.6.17 OMEGA is not responsible for lost or forgotten items (an additional charge will apply for the delivery of the item).

3.7 UTVs – GUIDED TOUR

3.7.2 Minimum age to drive UTV: 21 years / Minimum passenger age on UTV: 6 years.
3.7.3 Deposit of $1,500 USD per UTV on credit card.
3.7.4 It is necessary to have official identification (INE or passport).
3.7.5 For your safety we do not allow: Pregnant women, back problems or recent surgery, anyone under the influence of alcohol or drugs.
3.7.6 Damage to the UTVs, to your person or to third parties, is your responsibility.
3.7.7 Driving on beaches and federal highways is prohibited.
3.7.8 There are no refunds due to unforeseen external conditions, rescheduling will depend on our availability.
3.7.9 Those who do not attend must pay the entire activity fees.
3.7.10 Late arrival policy: A tolerance period of 15 minutes is established after the scheduled time. In case of delay, the tour will be rescheduled according to our availability or the duration of the activity will be shortened.

3.8 DIRT BIKES – GUIDED TOUR
3.8.1 Includes

- Safety equipment: Certified helmet, body armor, goggles, protective gloves, protective knee and elbow pads
- Assistance for any incident during the tour
- Gasoline
- Waters and snacks
3.8.2 Minimum age to drive a DIRT BIKE: 21 years old WITH EXPERIENCE and accompanied by their parent or guardian.
3.8.3 Deposit of $1,000 USD per DIRT BIKE on credit card
3.8.4 It is necessary to have official identification (INE or passport)
3.8.5 For your safety we do not allow: Pregnant women, back problems or recent surgery, anyone under the influence of alcohol or drugs.
3.8.6 Damage to the DIRT BIKES, to your person or to third parties, is your responsibility.
3.8.7 Driving on beaches and federal highways is prohibited.
3.8.8 There are no refunds due to unforeseen external conditions, rescheduling will depend on our availability.
3.8.9 Those who do not attend must pay the entire activity fees.

4. RENTALS
( per Hour, Day, Week or Month )
4.1 SCOOTER & NAVI HONDA – RENTAL
4.1.1 Includes Helmet
4.1.2 Mandatory deposit of $400 USD per Scooter or Navi Honda.
4.1.3 Minimum age to drive: 18 years.
4.1.4 Gasoline not included.
4.1.5 It is necessary to have official identification (INE or passport).
4.1.6 Maximum weight of 150 kg.
4.2 DUAL SPORT MOTORCYCLES – RENTAL
4.2.1 Includes Helmet
4.2.2 Hourly/day rentals do not include GPS or routes.
4.2.3 Damage to vehicles and/or third parties is your responsibility.
4.2.4 A deposit of $500 USD is required for Honda XR 150L.
4.2.5 Minimum driving age 18 years for Honda XR 150L.
4.2.6 Gasoline not included.
4.2.7 It is necessary to have official identification (INE or passport).
4.3 DIRT BIKES – RENTAL
4.3.1 Includes Safety Equipment
- Certified helmet
- Bulletproof vest
- Googles
- Protective gloves
- Knee Pads
- Protective elbow pads
4.3.2 Hourly/daily rentals do not include GPS or routes.
4.3.3 There is no insurance of any kind for Honda CRF 250F.
4.3.4 Damage to vehicles and/or third parties is your responsibility.
4.3.5 A deposit of $1,000 USD is required for Honda CRF 250F.
4.3.6 Minimum driving age 21 years for Honda CRF 250F.
4.3.7 Gasoline not included.
4.3.8 It is necessary to have official identification (INE or passport).
4.4 ATVs / UTVs – RENTAL
4.4.1 Includes Helmet and Googles for Driver and Passenger
4.4.2 Hourly/daily rentals do not include GPS or routes.
4.4.3 There is no insurance of any kind. Damage to vehicles and/or third parties is your responsibility.
4.4.4 A deposit of $700 USD per ATV / $1,500 USD per UTV is required.
4.4.5 It is strictly prohibited to drive ATVs / UTVs on the beach and federal highways.
4.4.6 Minimum driving age: 18 years for ATVs and 21 years for UTVs.
4.4.7 Gasoline not included.
4.4.8 It is necessary to have official identification (INE or passport).
4.4.9 Credit card deposit required.
4.4.10 Cancellations made 3 days in advance will be charged 30% of the total tour cost + taxes on your credit card.
4.4.11 There are no refunds on cancellations less than 24 hours before the scheduled day.
4.4.12 There is no refund for unforeseen weather conditions.
4.4.13 OMEGA is not responsible for damages to third parties, accidents or injuries caused by the adventure/rental.
4.4.14 The vehicles must be delivered in the same condition in which they were delivered to return your deposit.
4.4.15 Taxes included, no additional charges.
5. PRIVACY POLICY
We collect personal information from users to process reservations and improve our services. This information includes, but is not limited to, name, email address, phone number and payment details. We are committed to protecting the privacy of our users and will not share this information with third parties without your consent.
6. SECURITY POLICY
We implement various security measures to protect the personal information of our users. This includes using secure servers and encrypting sensitive data.
7. LIMITATION OF LIABILITY
We are not responsible for any damage, loss or injury that may occur while using our services. Users assume all risks associated with participating in our tours, renting vehicles and using our transportation services.
8. MODIFICATIONS TO THE TERMS
8.1 Right to Modify
We reserve the right to modify these terms and conditions at any time. We will notify users of any significant changes by posting a notice on our website or by email. Your continued use of our services following the posting of changes constitutes acceptance of the new terms.
8.2 Effective Date of Changes
Changes to the Terms and Conditions will be effective immediately upon posting on this page, unless otherwise indicated. The date of the last update will be clearly indicated at the beginning of this document.
9. DISPUTE RESOLUTION
In the event of a dispute, the parties agree to first attempt to resolve it amicably. Any dispute that arises in relation to the use of our services will be resolved in accordance with this OMEGA Tours, Rentals & Private Transportation Terms and Conditions document.
